Privacy Policy of Personal Information

Innovator Japan Inc. (hereinafter “the Company”) handles personal information in planning and development of Web services, production of websites tailored to computers and mobile terminals and other operations.

The Company will establish and implement a personal information protection management system in accordance with this Privacy Policy and all its personnel involved in business activities will work together to ensure the appropriate handling of personal information.

1. Acquisition, use and provision of personal information

The Company will acquire personal information in an appropriate manner in consideration of its business details and size, handle it to the extent necessary to fulfill the purposes of use and never use it in excess of the purposes of use specified prior to acquisition. In addition, the Company will not offer any personal information to third parties without the approval of the owner of the information. For this purpose, the Company will formulate different operation procedures to check the operation and to carry out internal audits.

2. Compliance with Laws and Ordinances

With respect to implementation of its personal information protection management system, the Company will comply with the Act on the Protection of Personal Information and other laws and ordinances concerning the handling of personal information, the guidelines associated with the Act mentioned above and other guidelines stipulated by the national government and other norms.

3. Implementation of Security Measures for Protection of Personal Information

To ensure the unfailing prevention of loss, destruction, falsification or leakage of any personal information, the Company will implement access control at its offices and security management of its information systems, give education to employees and introduce security measures at an appropriate and reasonable level in an effort to protect personal information.

In the event of outsourcing any operation involving the handling of personal information to contractors, the Company shall limit such contractors to those with their security level confirmed in accordance with the Company’s security standards for the protection of personal information.

In the event that any incident involving personal information occurs, the Company will take swift action to contain the damage and resolve the situation. In addition, the Company is prepared to analyze the causes of the incident to identify and resolve issues and to implement measures to prevent a recurrence.

4. Complaints and Inquiries on the Handling of Personal Information

The Company has set up a Privacy Inquiry Desk as a contact for complaints, inquiries and other matters on the handling of personal information to ensure a response without delay.

5. Continued Improvement of the Personal Information Protection Management System

In response to changes in social circumstances and the advancement of information technologies and in consideration of its own business environment, the Company will regularly check and review the details and the status of operation of the personal information protection management system to improve it.

The Company hereby declares that it will protect personal information in accordance with the policy set out above.

Handling of Users’ Personal Information

Innovator Japan Inc. (hereinafter “the Company”) has set forth the following provisions concerning the handling of users’ personal information in the services provided by the Company, as follows.

1. Personal information

As provided for by the Act on the Protection of Personal Information, personal information shall mean information about a living individual which can identify the specific individual by name, date of birth, address, telephone number, point of contact or other information contained in such information.

2. Method of collection of personal information

In the services provided by the Company, it may acquire users’ personal information such as name, address, date of birth, email address and credit card information.

3. Purposes of collecting/using personal information

The Company will collect/use personal information for the following purposes:

A) Provision/operation of the Company’s services;
B) Response to inquiries from users (including obtaining identity confirmation);
C) Sending email to users about new functions of the services used by the users, updates, campaigns, etc. and other information about other services provided by the Company;
D) Contacting users about maintenance work, important notices and other information as necessary;
E) Identifying users who have violated the terms and conditions of use or who intend to use the services for illegal or improper purposes, and terminating their use of the Company’s services;
F) Allowing each user to browse, change or delete his or her own registration information and check access logs; and
G) Charging fees for the use of paid services.

4. Provision of personal information to third parties

  1. The Company will not provide any personal information of a user to any third party without the prior consent of the individual in question except for cases falling under any of the following items. However, this shall not apply to cases permitted under laws and regulations:
  2. A) Cases based on laws and regulations;
    B) When it is necessary to protect life and limb or property, and obtaining the consent of the individual in question is difficult;
    C) When a particular need arises in order to improve public health or to advance the healthy upbringing of children, and obtaining the consent of the individual in question is difficult; or
    D) When it is necessary to cooperate with an agency of the state or local government organization or their agent in the execution of their duty according to laws and regulations, and obtaining the consent of the individual in question will likely pose a risk of interfering with the execution of this duty.
  3. Notwithstanding the provisions of the preceding paragraph, persons to which any of the following items applies shall not fall under third party:
  4. A) When the Company outsources all or part of the handling of the personal information within the scope necessary to accomplish the purposes of use;
    B) When the personal information is provided as a result of business succession due to merger or other reasons; and
    C) When the personal information is to be used jointly with specific persons and the individual in question has been notified of this fact in advance or has been placed in a position where he or she can readily learn of this fact or the items of personal information which are to be used jointly, the scope of the sharing, purpose of sharing and the name or title of person responsible for the management of said personal information.

5. Disclosure of personal information

If the Company receives a request from a user for the disclosure of his or her personal information, it will respond to such request without delay. However, if any of the following items applies as a result of such disclosure, the Company may choose not to disclose all or part of the personal information and if the Company determines not to disclose the personal information, it will notify the individual in question of same without delay. The Company will charge a requesting individual a handling fee of 1,000 yen per request for the disclosure of personal information:

A) When there is a possibility that such disclosure could harm the life, limb, property or other rights or interests of the user in question or a third party;
B) When there is a possibility that such disclosure could adversely affect appropriate business operation of the Company to a material degree; or
C) Other cases where such disclosure leads to a violation of laws and regulations.

6. Correction and deletion of personal information

  1. If there is a mistake in the personal information retained by the Company, the user in question may request the Company to correct or delete the personal information through procedures set forth by the Company.
  2. Upon receipt of a request from a user described in the preceding paragraph, if the Company determines it necessary to respond to the request, it will correct or delete said personal information without delay, and will notified the user in question of same.

7. Suspension of use, etc. of personal information

If the Company is requested by a user to suspend the use of or delete his or her personal information (hereinafter, “the suspension of use, etc.”) by reason of the personal information being used outside the scope of the purposes of use or by reason of the information having been obtained by dishonest means, the Company will carry out the necessary investigation without delay and, based on the result, will implement the suspension of use, etc., and notify the user in question of same. However, in the case where the suspension of use, etc. of the personal information may lead to significant cost burdens and in other cases where it is difficult to implement the suspension of use, etc., if there is a measure available to protect the rights and interests of the user in question, the Company will take said alternative measure.

8. Modification of this document

  1. The contents of this document may be modified without notifying users.
  2. Unless otherwise specified by the Company, this document after any modification shall take effect when posted on the website.
